1. Definitions
- "Services" means the legal advisory services provided by Thammarak, including Pension Eligibility Review, Appeal of Reduced or Withheld Benefits, and Documentation & Records Preparation.
- "Client" / "You" means any person who engages Thammarak to provide Services or who uses this website.
- "Website" means the website operated by Thammarak at the domain associated with this document.
- "Engagement Letter" means the written agreement setting out the scope, fee, and terms of a specific service engagement.
- "Agreement" means these Terms together with any applicable Engagement Letter.
2. Acceptance of Terms
By submitting an enquiry form, engaging our services, or using this website, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into a binding agreement
- You have read and understood these Terms
- You agree to be bound by these Terms and any applicable Engagement Letter
3. Service Description
Thammarak provides legal advisory services in connection with pension matters in Thailand. The specific scope of services for each client is set out in an Engagement Letter issued prior to commencing work. Our three standard services are:
- Pension Eligibility Review (฿1,800 THB)
- Appeal of Reduced or Withheld Benefits (฿5,600 THB)
- Documentation & Records Preparation (฿3,700 THB)
Services are available to individuals located in Thailand. We do not accept engagements requiring us to act as counsel in foreign jurisdictions.
4. Client Responsibilities
To enable us to provide services effectively, you agree to:
- Provide accurate, complete, and truthful information about your situation and documents
- Inform us promptly of any change in circumstances that may affect your case
- Respond to requests for information or documentation within reasonable timeframes
- Not use our services for any unlawful purpose or to advance a fraudulent claim
- Treat our staff with respect in all communications
5. Payment Terms
- Fees are stated in Thai Baht (THB) and are payable as agreed in the Engagement Letter
- Payment is typically required before or at the commencement of work, unless otherwise agreed in writing
- Accepted payment methods will be specified in the Engagement Letter
- Fees are non-refundable once work on a matter has commenced, unless we are unable to deliver the agreed service due to circumstances within our control
- Any additional scope beyond the standard service will be discussed and agreed in writing before the additional work is undertaken
6. Service Delivery
- We will carry out work with reasonable professional care and skill
- Timelines stated at the outset are estimates and may vary depending on the response of third-party authorities or the completeness of information provided by you
- We will keep you informed of progress and notify you of any significant delays as soon as reasonably practicable
- All case-related communications will be treated as confidential in accordance with our Privacy Policy
7. Intellectual Property
All content on this website, including text, layout, and design, is the property of Thammarak and may not be reproduced, distributed, or used without our written permission. Written advice, submissions, and documents prepared for your case remain our professional work product; copies provided to you are for your personal use in connection with your matter only.
8. Disclaimers
- Information on this website is for general guidance only and does not constitute legal advice
- The outcome of any pension matter depends on the specific facts, the applicable law at the time, and decisions made by relevant authorities — we cannot predict or commit to any particular result
- We are not responsible for decisions made by the Social Security Office, Government Pension Fund, or any other external body
9. Limitation of Liability
To the extent permitted by Thai law:
- Our total liability to you in connection with any service engagement shall not exceed the fee paid for that specific service
- We are not liable for indirect, consequential, or incidental loss arising from the provision of our services or the outcome of your matter
- We are not liable for delays or failures resulting from circumstances beyond our reasonable control, including acts of government agencies or third parties
10. Termination
- Either party may terminate an engagement by giving written notice
- If you terminate before work is complete, we will charge for work reasonably carried out to the date of termination
- We may terminate an engagement if you provide false or misleading information, if continued representation would be contrary to professional obligations, or in cases of persistent non-cooperation
- Provisions relating to confidentiality, payment, and dispute resolution survive termination
11. Dispute Resolution and Governing Law
These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute:
- We will first attempt to resolve any disagreement informally through direct communication
- If informal resolution is not achieved within 30 days, the matter may be referred to mediation by a mutually agreed mediator
- Where mediation does not resolve the matter, disputes shall be subject to the jurisdiction of the courts of Bangkok, Thailand
12. General Provisions
- Entire agreement: These Terms, together with the Engagement Letter, form the entire agreement between us
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in force
- Waiver: Failure to enforce any provision does not constitute a waiver of our right to enforce it in future
- Assignment: You may not assign rights under this agreement without our written consent
- Notices: Formal notices should be sent to the address or email below
13. Changes to These Terms
We may update these Terms from time to time. Revised Terms will be published on this page with a new effective date. Continued use of our services after that date constitutes acceptance of the updated Terms.
